Yes, as long as you haven’t received any VA medical benefits during the preceding three months and you are currently enrolled in a qualified HDHP, you may open and contribute to an HSA.
Effective January 1, 2016, there is an exception to this restriction.
If your benefits are provided in connection with a service-connected disability you are eligible to open and contribute to an HAS, as long as you are enrolled in a qualified HDHP, regardless of when the VA benefits are received.
